The Residence Permit for salaried workers requires a certificate of labour market testing from the labour authorities and an employment contract in Luxembourg. The worker must apply for a temporary authorisation to stay in Luxembourg.
The Residence Permit for workers posted from outside the EU applies to transferees who remain on home country contract and payroll and are temporarily assigned by a company outside the EU to a client company in Luxembourg to fulfil a service provision for a fixed period over 90 days. A third-country worker posted to Luxembourg by a service provider established outside the EU must have an authorisation to stay before entering Luxembourg. The employer must apply for an authorisation for collective posting before his employees can receive a temporary authorisation to stay.
